Federal Judge Rules In Favor Of Border Wall, Pres. Trump Delays Project Until Entire Wall Approved

FILE – This Oct. 26, 2017 file photo shows prototypes of border walls in San Diego. A federal judge in San Diego who was taunted by Donald Trump during the presidential campaign has sided with the president on a challenge to building a border wall with Mexico. U.S. District Judge Gonzalo Curiel on Tuesday, Feb. 27, 2018 rejected arguments by the state of California and advocacy groups that the administration overreached by waiving laws requiring environmental and other reviews before construction could begin. A federal judge recently delivered a blow to the state of California and environmental groups who have tried to stop the construction of President Trump’s border wall.
In a 101 page ruling, Judge Gonzalo Curiel said the Trump administration, specifically the Department of Homeland Security, did not over-step it’s bounds with the construction of eight border wall prototypes in San Diego County or the border fence replacement project in Calexico near the Arizona border.
The state of California and activists claimed the administration’s waiver of environmental laws to expedite the projects violated state laws as well as the National Environmental Protection Act.
Those laws require government agencies to have an environmental assessment performed as well as an environmental impact report made available to the public before any projects can begin.
The law, however, does not apply to actions made by the president or Congress.
Judge Curiel’s ruling further stated the projects did not violate the constitution, and the Department of Homeland Security has wide discretion when it comes to border security.
The president took to Twitter, calling the ruling a “big legal win” allowing the project to go forward.
Big legal win today. U.S. judge sided with the Trump Administration and rejected the attempt to stop the government from building a great Border Wall on the Southern Border. Now this important project can go forward!
However, one of the activist groups who brought forth the lawsuit said they plan to appeal the judge’s ruling, and California’s attorney general has also vowed to keep fighting the construction of the wall.
Just one day later the president reiterated his stance on securing the entire southern border, saying on Twitter that, though California wants the wall built now, those sections will not be built until the whole project is approved.
I have decided that sections of the Wall that California wants built NOW will not be built until the whole Wall is approved. Big victory yesterday with ruling from the courts that allows us to proceed. OUR COUNTRY MUST HAVE BORDER SECURITY!

Congress has yet to enact funding for the proposed border wall.
