Department Of Justice Unveils New Policy On Handling Corporate Crime

The Justice Department is unveiling a new policy on how it will deal with corporate and so-called “white collar” crime.
Deputy Attorney General Rod Rosenstein made the announcement Wednesday before the New York City Bar White Collar Crime Institute.

Current law allows multiple federal agencies to threaten prosecution in attempt to garner settlements, but the new policy would reserve prosecution only for companies suspected of crimes.
Rosenstein said the goal of the new policy was to reduce the duplication of investigations and subsequent punishments as well as encourage cooperation between federal departments.
“Our new policy discourages ‘piling on’ by instructing department components to appropriately coordinate with one another and with other enforcement agencies in imposing multiple penalties on one company in relation to investigations of the same misconduct, stated Rosenstein.”
While the new policy will be incorporated into the U.S. attorney’s manual, Rosenstein said it will not be enforceable in the court room.
